Action Alert: Show Your Support for Governor Huntsman's Veto of HB 353

4/1/2009 —

Last week, we called on Governor Huntsman to veto a bill with important First Amendment implication. We're happy to report that the Governor has vetoed the bill!

But we're not yet in the clear. Utah legislators are deciding whether to override the Governor's veto.  If you are concerned about this bill, now is the time to express your views.

Action Alert:
Last week, Governor's Hunstman vetoed House Bill 353. This bill would impose penalties on retailers for not enforcing the age ratings and recommendations placed on video games, films, and other products.  As NCAC pointed out, the bill poses serious First Amendment and practical problems in trying to  restrict minors' access to legal materials. (See our letter here.)

Fortunately, the Governor did the right thing and vetoed the bill.  But the battle isn't over yet.  The legislature, which passed the bill by large majorities, could still override the Governor's veto.

Legislators are in the process of deciding whether to try to override the veto.  Anyone concerned about the constitutionality and wisdom of the bill should contact their legislators and urge them to support the Governor's decision.
